Welcome to Gympop. These Terms of Service ("Terms") govern your use of our website www.gympop.co.uk (the "Site") and the purchase of our products. By accessing or using our Site, you agree to be bound by these Terms.

By using our Site, placing an order, or purchasing our products, you confirm that:

  • We reserve the right to update product descriptions, specifications, and pricing without notice
  • Print-on-demand products may have slight variations in print placement and colour

2.2 Product Availability

  • All products are subject to availability
  • We reserve the right to discontinue products at any time
  • If a product becomes unavailable after you place an order, we will notify you and offer a refund or alternative

2.3 Pricing

  • All prices are displayed in British Pounds (GBP £)
  • Prices include VAT where applicable
  • We reserve the right to change prices at any time without prior notice
  • The price charged will be the price displayed at the time of order placement
  • Promotional pricing and discounts are subject to terms and expiration dates

3. Orders and Payment

3.1 Placing an Order

When you place an order:

  • You are making an offer to purchase the products in your cart
  • We will send you an order confirmation email (this does not constitute acceptance of your order)
  • We reserve the right to accept or decline your order for any reason
  • A contract is formed when we dispatch your order and send a shipping confirmation

3.2 Payment Methods

  • We accept major credit and debit cards through Shopify Payments
  • Digital wallets: Apple Pay, Google Pay, Shopify Pay
  • Payment is processed securely and in compliance with PCI DSS standards
  • Payment must be received in full before orders are dispatched

3.3 Order Cancellation

  • You may cancel your order within 24 hours of placement by contacting us at gympop@mail.com
  • Once production has begun (for print-on-demand items), orders cannot be cancelled
  • We reserve the right to cancel orders due to pricing errors, product unavailability, or suspected fraud

4. Shipping and Delivery

4.1 Shipping Locations

We currently ship to:

  • United Kingdom
  • European Union countries (27 countries)

4.2 Delivery Times

  • Estimated delivery times are provided at checkout
  • Delivery times are estimates and not guaranteed
  • Print-on-demand products typically take 5-10 business days for production plus shipping time
  • We are not responsible for delays caused by shipping carriers, customs, or force majeure events

4.3 Shipping Costs

  • Shipping costs are calculated at checkout based on destination and order weight
  • International orders may be subject to customs duties and import taxes (customer's responsibility)

4.4 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the shipping carrier.

5. Returns and Refunds

5.1 Return Policy

We want you to be satisfied with your purchase. You may return products within 30 days of delivery if:

  • The product is unused, unworn, and in original condition with tags attached
  • The product is in its original packaging
  • You provide proof of purchase

5.2 Non-Returnable Items

The following items cannot be returned:

  • Custom or personalized products
  • Products marked as final sale or clearance
  • Items damaged due to misuse or normal wear and tear

5.3 Return Process

To initiate a return:

  1. Contact us at gympop@mail.com within 30 days of delivery
  2. Provide your order number and reason for return
  3. We will provide return instructions and a return authorization
  4. Ship the item back to us at your expense (unless the item is defective or incorrect)

5.4 Refunds

  • Refunds will be processed within 5-10 business days of receiving the returned item
  • Refunds will be issued to the original payment method
  • Shipping costs are non-refundable (unless the return is due to our error)
  • You are responsible for return shipping costs unless the item is defective or incorrect

5.5 Defective or Incorrect Items

If you receive a defective or incorrect item:

  • Contact us within 7 days of delivery
  • Provide photos of the defect or incorrect item
  • We will arrange a replacement or full refund (including return shipping)

6. Intellectual Property

6.1 Ownership

All content on this Site, including but not limited to:

  • Text, graphics, logos, images, and designs
  • Product names, slogans, and branding
  • Software, code, and functionality

is the property of Gympop or our licensors and is protected by UK and international copyright, trademark, and intellectual property laws.

6.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or publicly display Site content without permission
  • Modify, reverse engineer, or create derivative works
  • Use automated systems (bots, scrapers) to access the Site
  • Use our trademarks or branding without written consent

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Site or servers
  • Transmit viruses, malware, or harmful code
  • Collect or harvest information about other users
  • Engage in fraudulent activity or attempt to bypass payment systems

8. Limitation of Liability

To the fullest extent permitted by law:

  • Gympop shall not be liable for any indirect, incidental, special, or consequential damages
  • Our total liability for any claim arising from your use of the Site or purchase of products shall not exceed the amount you paid for the product(s) in question
  • We are not liable for delays, failures, or interruptions in service beyond our reasonable control

This limitation does not affect your statutory rights as a consumer under UK law.

You agree to indemnify and hold harmless Gympop, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights

This does not affect your statutory rights under UK consumer protection laws.

17. Consumer Rights Notice

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods without giving any reason. To exercise this right, you must inform us of your decision to cancel. You must return the goods within 14 days of informing us of your cancellation. We will reimburse you within 14 days of receiving the returned goods.

Exceptions: This cancellation right does not apply to personalized or custom-made products.
